The New York Miscellaneous Forms section contains additional forms and elections that may apply to certain taxpayers. These entries are generally used for estimated tax payments, underpayment penalties, extension forms, spouse allocations, and other special situations.
Pathway to this entry is:
New York State Return > Miscellaneous Forms
What Is Included in the Miscellaneous Forms Section?
The New York Miscellaneous Forms section includes:
- Estimated Tax Payments
- Underpayment of Estimated Tax
- Non E-Fileable Forms
- Nonobligated Spouse Allocation (Form IT-280)
- Other Penalties and Interest
Most taxpayers will not need to complete every section.
Estimated Tax Payments
Use this section to report New York estimated tax payments that were not already entered on the federal return.
Pathway to this entry is:
New York State Return > Miscellaneous Forms > Estimated Tax Payments
What Are Estimated Tax Payments?
Estimated tax payments are payments made directly to New York during the year to cover expected tax liabilities.
Estimated payments are commonly made by taxpayers who:
- Are self-employed.
- Receive investment income.
- Receive retirement income without withholding.
- Have income not subject to withholding.
Important Information
Estimated payments entered in the federal section of the return generally transfer automatically to the New York return.
Before entering additional payments, verify that they have not already been included elsewhere in the return.
Underpayment of Estimated Tax
Use this section if you may owe an underpayment penalty because insufficient tax was paid throughout the year.
Pathway to this entry is:
New York State Return > Miscellaneous Forms > Underpayment of Estimated Tax
When Might This Apply?
You may be subject to an underpayment penalty if:
- Not enough tax was withheld from income.
- Required estimated tax payments were not made.
- Estimated payments were made late.
- Payments were substantially less than the required amount.
The program may calculate the penalty automatically based on the information entered in the return.
Non E-Fileable Forms
This section contains New York forms that cannot be electronically filed through the return and requires mailing additional documentation.
Pathway to this entry is:
New York State Return > Miscellaneous Forms > Non E-Fileable Forms
New York IT-370 Extension Form
The IT-370 is New York's Application for Automatic Six-Month Extension of Time to File for Individuals.
This form provides additional time to file a New York return but does not extend the time to pay any tax due.
If tax was owed, payment should generally have been made by the original due date to avoid penalties and interest.
Important Information
Returns requiring unsupported forms or attachments may need to be mailed to New York State rather than electronically filed.
Nonobligated Spouse Allocation (Form IT-280)
The Nonobligated Spouse Allocation allows a spouse to protect their portion of a joint New York refund when the other spouse owes certain debts.
Pathway to this entry is:
New York State Return > Miscellaneous Forms > Nonobligated Spouse Allocation (Form IT-280)
What Is a Nonobligated Spouse?
A nonobligated spouse is a spouse who does not owe the debt that may be collected from a joint refund.
Examples of qualifying debts may include:
- Past-due child support.
- Certain government debts.
- Other obligations subject to offset.
Why Complete Form IT-280?
Form IT-280 allows New York to determine whether part of a joint refund belongs to the spouse who is not responsible for the debt.
Completing the form may help preserve that spouse's share of the refund.
Other Penalties and Interest
Use this section only if you need to report additional penalties or interest that are not automatically calculated on the return.
Pathway to this entry is:
New York State Return > Miscellaneous Forms > Other Penalties and Interest
What Should Be Entered?
Enter only penalties or interest amounts that:
- Have been specifically determined.
- Are required to be reported separately.
- Are not already included elsewhere on the return.
Most taxpayers will leave this field blank. If you are unsure or need more information, please see the New York Sate Instruction booklet here.
How Do These Forms Affect My Return?
Entries in the Miscellaneous Forms section may:
- Increase tax due.
- Reduce a refund.
- Report extension information.
- Protect a spouse's share of a joint refund.
- Satisfy special New York filing requirements.
The effect depends on the form being completed.
Important Information
- Most taxpayers will only need one or two entries from this section.
- Estimated payments entered on the federal return generally transfer automatically to the New York return.
- Filing an extension extends the time to file, not the time to pay.
- Form IT-280 should only be completed when one spouse owes a debt subject to refund offset.
- Additional penalties and interest should only be entered when specifically required.
- Some forms may require mailing documents to New York State.
Additional Information
Before completing the Miscellaneous Forms section, review your estimated tax payments, extension filings, refund allocations, and any special New York requirements. Keeping supporting documentation with your tax records can help verify amounts entered on the return.
