Generally, the filing status for an Oklahoma tax return would match the filing status on the federal return. There is an exception to this when one spouse is a full-year Oklahoma resident and the other spouse is a full-year nonresident (non-military). The married taxpayers can elect to either match their federal return and file as Married Filing Jointly or they can file Married Filing Separately. The full-time Oklahoma resident would filing the MFS Oklahoma return.
If the non-resident spouse also has an Oklahoma filing requirement, they would file a Form 511-NR form using the Married Filing Separate status.
Please note: If the filing status is changed from MFJ to MFS on the Oklahoma return, the return cannot be filed electronically, and it will need to be mailed to the state.
