According to the instructions, your California residency for tax purposes is as follows:
A California Resident is a person that lived in California permanently for the full year. The individual may have spent time outside of California on a temporary basis.
A California Nonresident is any individual that is not a resident.
A California Part-Year Resident is an individual that is a resident for part of the year and a nonresident for part of the year.
If one spouse is a resident and the other is not and a joint federal return was filed, you should file a joint nonresident California return.
Since California is a community property state, if one spouse has California source income, both spouses will have California source income.
California Form 540 and 540NR
To file California Form 540 (resident return) or Form 540NR (nonresident return), go to the State section of your TaxSlayer account. Click 'Get Started' and select the state to begin your California tax return. This form is used to file state taxes and includes information such as income, deductions, tax credits, and any taxes owed or refunds due. Part-year residents will file Form 540NR to report income earned while a resident and nonresident of California.
